I have been speaking with the state police in Albany over the last several months about getting my new ammunition sellers permit. The forms just became available around January 10th and had to be postmarked by Jan15, the day the new law went into effect. So, as we all now know, you can no longer purchase ammo online and it now has to be a face to face transaction.
My new permit just arrived but did not contain any instructions as to background checks and record keeping. So I called again to get clarification as to what I need to do and what information needs to be recorded and for how long. The short story is NY State still does not have a background system in place and the Feds will not allow NY to use the NICS system, so, no background checks for now and also no records of transactions needs to be recorded for now. They said they will notify licensed ammo sellers if and when the system is properly in place.
In addition, the DEC's system for hunting licenses is still down and they don't know when that will be up and running again.
If you hunt in NY, save your old license as proof that you took a hunter safety course because they have lost everyone's information and at present they do not have a way to get the information back. It appears it has been purged from the new system when they tried to migrate the info over.
What this means is that every hunter that can not produce an old license or hunters safety certificate will have to take the classes over again.
What I found most troubling is that the system has been down since mid December and there is no way for them to even issue a license, as we found out last week. When I spoke to the regional DEC office to ask what someone should do if they can't get a license I was told to have them make a "fake license" that has their name, address and all the other usual information that the license would have on it and to include a note saying they had tried to get a license but due to the system failure they were unable to do so.
If stopped by any LEO you will need to present this "fake license" so you do not get a summons. The DEC plans to check all the names form any stops this season and they will be checking to make sure you have purchased a new license when they become available. If you don't they will be issuing a summons via mail to you for not following up and purchasing the license when they become available.
You have to love this state. It still amazes me that they can pass these laws and have no way of tracking or enforcing them.
